These Terms of Service ("Terms") govern your use of the TRND mobile application ("App"), developed by TRND LLC ("TRND"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Acceptance of Terms

By using the App, you affirm that you are at least 18 years of age or possess legal parental or guardian consent to agree to these Terms. You also acknowledge that you have read, understood, and agree to be bound by these Terms.

2. License

Subject to your compliance with these Terms, TRND grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not modify, distribute, sell, lease, or create derivative works based on the App or any part thereof.

3. Privacy and Data Collection

The App may collect and utilize certain personal information and real-time location data to enhance the functionality and user experience. By using the App, you consent to the collection, storage, and use of your information as outlined in the Privacy Policy available within the App.

4. User Responsibilities

(a) You are solely responsible for the accuracy and legality of the information you provide through the App.

(b) You shall not use the App for any illegal, harmful, or unauthorized purpose, or in any way that violates these Terms.

(c) You shall not interfere with or disrupt the App's functionality or compromise its security.

(d) You agree not to access, copy, or transmit any part of the App's code or content without prior written permission from TRND.

5. Intellectual Property

The App and all associated intellectual property rights are owned by TRND. You agree not to use or infringe upon any trademarks, copyrights, or other proprietary rights related to the App without the express written consent of TRND.

6. Limitation of Liability

(a) The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

(b) In no event shall TRND be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with the use of the App.

(c) TRND disclaims any liability for the actions, content, or conduct of any third-party users or providers of services through the App.

7. Indemnification

You agree to indemnify, defend, and hold harmless TRND and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

8. Modifications to the Terms

TRND reserves the right to modify or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically. Continued use of the App after any modifications constitutes your acceptance of the revised Terms.

9. Termination

TRND reserves the right to suspend or terminate your access to the App, in whole or in part, for any reason or no reason, without liability to you or any third party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

11. Payments and Ticket Sales

(a) Payment Processing: The App allows users to create and sell tickets for events using Stripe, a third-party payment processor. By using this feature, you agree to comply with Stripe’s terms and conditions, which are available on Stripe’s website. TRND does not process payments directly and is not responsible for any payment disputes or issues that arise between users and Stripe.

(b) Ticket Sales: When you create a ticketed event on the App, you are responsible for setting the ticket price and managing the sale of tickets. All transactions, including ticket purchases, are handled through Stripe. TRND is not involved in the transaction process between buyers and sellers beyond providing the platform for the transaction.

(c) Refunds: All ticket sales are final unless otherwise specified by the event organizer. Refunds for tickets are at the sole discretion of the event organizer. TRND does not guarantee refunds and is not responsible for handling or processing refund requests. Any disputes related to refunds should be directed to the event organizer and not TRND.

(d) Liability: TRND is not liable for any issues or disputes related to payments or ticket sales, including but not limited to, failed transactions, fraudulent transactions, or disputes between users. Users agree to hold TRND harmless from any claims or damages arising from their use of the payment and ticketing features on the App.

(e) Fees: Any fees associated with the use of Stripe for processing payments, including transaction fees and service fees, are the responsibility of the user. TRND may charge additional fees for certain features or services related to ticketing, which will be disclosed to you at the time of the transaction.
